1. Agreement to Terms
By accessing or using Desktop Insights (“Service”), operated by Desktop Insights (“Company”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Desktop Insights is a technographics platform that tracks SDKs, frameworks, and dependencies used by macOS and Windows desktop applications. We provide data and analytics through a web-based dashboard available via paid subscription plans.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately at support@desktopinsights.com if you suspect unauthorized access.
4. Subscriptions and Payment
Access to the Service requires a paid subscription. By subscribing, you authorize us to charge the applicable fees to your payment method. Subscriptions renew automatically at the end of each billing period unless canceled. All fees are non-refundable except as required by law.
5. Acceptable Use
You agree not to:
- Resell, sublicense, or redistribute data obtained from the Service without a separate data license agreement from Desktop Insights.
- Reproduce, publish, or cite data from the Service in commercial materials (including but not limited to blog posts, marketing collateral, press releases, sales presentations, or research reports) without a data license agreement.
- Use automated means (scrapers, bots, or programmatic access) to extract data from the Service beyond what the API or export features explicitly provide.
- Systematically download, cache, or store data from the Service for the purpose of building a competing product or dataset.
- Attempt to reverse-engineer, decompile, or disassemble the Service.
- Use the Service in violation of any applicable law or regulation.
- Interfere with or disrupt the integrity or performance of the Service.
Linking to publicly available pages and referencing aggregate statistics for editorial, academic, or personal commentary is permitted as described in Section 6.1.
6. Data Licensing and Commercial Use
Desktop Insights data, including technographic profiles, market share statistics, SDK adoption metrics, and application-level dependency data, is proprietary and protected as a compilation work under applicable intellectual property laws.
6.1 Free Access and Editorial Use
Publicly available data on the Service (such as aggregate statistics displayed on public pages) may be viewed by anyone. You may reference publicly displayed statistics with appropriate attribution (e.g., “Source: Desktop Insights” with a link to the source page) for the following purposes without a license:
- Personal, non-commercial use.
- Journalism and editorial coverage (news articles, blog posts, newsletters, podcasts, or similar editorial content) where Desktop Insights data is reported on or discussed, rather than used to promote the author’s own product or service.
- Academic research and educational materials.
- Social media commentary and discussion.
6.2 Promotional Use Requires a License
A data license agreement is required when Desktop Insights data is used to promote, market, or sell your own products or services. Promotional use includes, but is not limited to:
- Marketing materials, whitepapers, case studies, or press releases that position your product using Desktop Insights data (e.g., “76% of desktop apps choose us”).
- Sales presentations, pitch decks, or investor materials.
- Incorporating data into commercial reports, dashboards, or products distributed to third parties.
- Using data for competitive intelligence, lead generation, or sales prospecting purposes.
6.3 Citation Rights
Licensed customers receive explicit rights to cite Desktop Insights as a source in their commercial materials (e.g., “Source: Desktop Insights” or “According to Desktop Insights research”). The scope, duration, and permitted formats of citation are defined in each customer’s data license agreement.
6.4 Custom Data and Early Access
Custom data cuts, filtered datasets, historical trend data, and early access to upcoming reports are available exclusively under paid data license agreements. Contact sales@desktopinsights.com for licensing inquiries.
7. Intellectual Property
The Service, including its design, code, data compilations, analytical methodologies, and derived insights, is owned by Desktop Insights and protected by intellectual property laws. Our data compilations constitute original works of authorship reflecting substantial creative effort in selection, coordination, and arrangement. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, subject to the data licensing terms in Section 6.
8. Data Accuracy
We strive to provide accurate technographic data but do not guarantee that all data is complete, current, or error-free. The Service is provided for informational purposes, and you should independently verify data before making business decisions based on it.
9. Limitation of Liability
To the fullest extent permitted by law, Desktop Insights shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Termination
We may suspend or terminate your access to the Service at any time for conduct that violates these Terms or is otherwise harmful to other users or the Service. You may cancel your subscription at any time through your account settings; access continues until the end of your current billing period.
Upon termination, your right to use and cite Desktop Insights data under any active data license agreement also terminates, unless the license agreement provides otherwise. You must cease commercial use of any licensed data within 30 days of termination.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
